These Terms of Service ("Terms") govern your access to and use of trendnalysis.trading and related tools and content (the "Service"), operated by TrendNalysis LLC ("TrendNalysis," "we," "us"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using it, you represent that you meet these requirements.

2. What the Service is and is not

TrendNalysis provides educational and informational market analysis, charts, screening tools, and market data. It is a research and education tool only. It is not financial, investment, tax, or legal advice, is not a recommendation to buy or sell any security, and does not create any advisory or fiduciary relationship. See our Financial Disclaimer. You are solely responsible for your own decisions and should consult a licensed professional before investing.

3. Accounts

Some features require an account (when available). You agree to provide accurate information, keep your credentials secure, and accept responsibility for activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

4. Subscriptions and billing

When paid plans launch, the following applies: paid plans are billed on a recurring basis (for example, monthly) at the price shown at checkout, through our payment processor (Stripe). Your subscription renews automatically until you cancel. You can cancel at any time, effective at the end of the current billing period. Unless required by law or expressly stated, fees are non-refundable for partial periods. We will give notice of material price changes. (This section takes effect when subscriptions are offered.)

5. Acceptable use

You agree not to:

Scrape, harvest, or systematically extract data or tool output, or resell or redistribute the Service or its content without permission.
Reverse engineer, decompile, or attempt to derive the underlying models, scoring, or methodology of the Service.
Share, resell, or provide unauthorized access to paid features or your account.
Interfere with, overload, or disrupt the Service or its infrastructure, or attempt to bypass access controls or rate limits.
Use the Service for unlawful purposes or in violation of applicable securities or other laws.

6. Intellectual property

The Service, including its software, analytics engine, scoring methods, design, text, and branding, is owned by TrendNalysis and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms. All rights not expressly granted are reserved.

7. Third-party data and links

The Service relies on third-party data (for example, Yahoo Finance, FRED, and the U.S. Bureau of Labor Statistics) and may link to third-party sites. We do not control and are not responsible for third-party data accuracy, availability, or content. Market data may be delayed or contain errors.

8. No warranty

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any analysis, signal, or data will be accurate or profitable.

9. Limitation of liability

To the maximum extent permitted by law, TrendNalysis and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any trading or investment losses, lost profits, or lost data, arising from your use of (or inability to use) the Service. To the extent any liability is found, it will not exceed the amount you paid us for the Service in the 12 months before the claim (or, if you paid nothing, US $100).

10. Indemnification

You agree to indemnify and hold harmless TrendNalysis from claims, losses, and expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your access at any time for any reason, including violation of these Terms. Provisions that by their nature should survive (for example, intellectual property, disclaimers, limitation of liability) will survive termination.

12. Changes to the Service or Terms

We may modify or discontinue the Service, and may update these Terms, at any time. We will post the updated Terms here with a new "Last updated" date. Continued use after changes means you accept the revised Terms.

13. Governing law

TrendNalysis is operated by TrendNalysis LLC, a California limited liability company. These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in California, except where prohibited by law.
